If you are a Publisher, you are responsible for:
-Completing tasks and surveys accurately and honestly.
-Providing accurate and truthful information in your Publisher profile.
-Delivering high-quality services to advertisers as per agreed-upon terms.
-Complying with all applicable laws and regulations, including but not limited to consumer protection laws and data privacy regulations.

5. Advertiser Responsibilities
If you are an Advertiser, you are responsible for:
-Ensuring that your advertising campaigns comply with all applicable laws and regulations, including but not limited to advertising standards, consumer protection laws, and data privacy regulations. -Providing accurate and truthful information in your advertising campaigns. -Treating Publishers fairly and respectfully. -Paying Publishers promptly for completed tasks and services.

6. Intellectual Property
-All intellectual property rights in and to the Services, including but not limited to trademarks, copyrights, and patents, are owned by Xirads or its licensors. -You may not use any Xirads trademarks or logos without the prior written consent of Xirads.

7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. XIRADS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

8. Limitation of Liability
IN NO EVENT SHALL XIRADS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF XIRADS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Dispute Resolution
Any dispute arising from these Terms will be first attempted to be resolved through informal negotiations. If unsuccessful, the dispute shall be finally and exclusively resolved through binding arbitration administered by XIRADS, with the arbitrator selected according to their rules. The arbitration shall be conducted in europe and governed by the laws of EU. The arbitrator's decision will be final and binding, except for limited exceptions such as small claims court matters or injunctive relief for intellectual property rights violations.

Xirads may modify these Terms from time to time. We will notify you of any material changes by posting the revised Terms on the Platform and updating the "Last Updated" date. Your continued use of the Services after the effective date of any such modifications constitutes your acceptance of the revised Terms.
